San Francisco Proposal For Tenant ISP Choice - Community Broadband Bits Podcast 231

Cities across America are implementing policies that create friendly environments for Internet Service Providers in order to encourage competition. In San Francisco, the Board of Supervisors is now considering legislation that will create choice for residents or businesses in multi-welling units, or MDUs. In episode 231, Mark Farrell, a member of the Board of Supervisors, joins us to discuss the proposal.

City leaders have worked in various ways to chip away at the digital divide and have discovered that a number of MDU building owners do not allow more than one ISP access to their buildings. As a result, residents have no option but to subscribe to the ISP of the owner’s choice, or have no service at all. The proposed ordinance will put an end to that practice by ensuring that building owners do not deny tenants choice and do not deny ISPs access to their buildings.

In this interview, Mark discusses the need for the ordinance and what city leaders hope to achieve with this new policy. When they investigated the issue, they realized that it impacted a significant number of stakeholders. Mark acknowledges the care of the city’s approach in encouraging competition, supporting responsible entrants, and doing so in a community with a range of old and new structures. The city is eager to improve their connectivity and this policy is one step in a larger plan.

H.R. Trostle On Co-ops, Munis, Connectivity In North Carolina - Community Broadband Bits Podcast 224

In June, North Carolina released a report pronouncing that 93 percent of the state has access to broadband speeds. At the Institute for Local Self-Reliance, our Research Associate H.R. Trostle, who has been examining reporting data in North Carolina for the past year, came to some very different conclusions. In episode 224, she and Christopher talk about the report they co-authored, which gives a different perspective on the connectivity situation in the Tar Heel State.

In their report, North Carolina Connectivity: The Good, The Bad, and The Ugly, Trostle discovered that, while urban areas have been well served by the big private providers, those same national companies have shunned rural areas. Instead, rural cooperatives and municipal networks are attempting to serve their residents and businesses with high-quality Internet access. It isn’t easy, however, when state laws discourage investment and access to federal funding.

Trostle gets into her analysis of the data, its limitations, and what we can learn from both. She and Chris go through some of the recommendations they provide to the state of North Carolina as it moves forward. The obvious first step is to repeal the state’s barrier on municipal network expansion, which has caused real harm in Pinetops, North Carolina. They also offer advice on how to facilitate telephone and electric cooperative investment and what that could mean for rural North Carolina.

Authors Discuss NC Report On PRX

We have extensively studied the connectivity situation in North Carolina and just released our report, “North Carolina Connectivity: The Good, The Bad, and The Ugly.” Now you can hear from the report authors, H.R. Trostle and Christopher Mitchell, in our most recent PRX coverage.

We spoke with both authors who gave us a recap of the situation in urban and rural North Carolina. They explained how they examined the data and came to the conclusion that, while urban areas are served relatively well by big private providers, the same cannot be said in rural areas. Unless a muni or rural telephone or electric cooperative offers Internet access in a rural region, odds are rural residents and businesses just don’t have access to FCC defined broadband speeds. North Carolina Connectivity: The Good, The Bad, and The Ugly

North Carolina's digital divide between urban and rural communities is increasing dangerously in a time when high quality Internet access is more important than ever. Rural and urban areas of North Carolina are essentially living in different realities, based on the tides of private network investment where rural communities are severely disadvantaged. The state has relied too much on the telecom giants like AT&T and CenturyLink that have little interest in rural regions.

The state perversely discourages investment from local governments and cooperatives. For instance, electric co-ops face barriers in seeking federal financing for fiber optic projects. State law is literally requiring the city of Wilson to disconnect its customers in the town of Pinetops, leaving them without basic broadband access. This decision in particular literally took the high-speed, affordable Internet access out of the hands of North Carolina's rural citizens.

The lengths to which North Carolina has gone to limit Internet access to their citizens is truly staggering. Both a 1999 law limiting electric cooperatives' access to capital for telecommunications and a 2011 law limiting local governments' ability to build Internet networks greatly undermine the ability of North Carolinians to increase competition to the powerful cable and DSL incumbent providers. 

In the face of this reality, the Governor McCrory's Broadband Infrastructure Office recommended a "solution" that boils down to relying on cable and telephone monopolies' benevolence. What this entire situation comes down to is a fundamental disadvantage for North Carolina's rural residents because their state will not allow them to solve their own problems locally even when the private sector abandons them.

Eugene Encouraged: Expanding Fiber Project

For the past year, Eugene has worked on a pilot project to bring high-quality connectivity to businesses in its downtown core. Now that community leaders and businesses have seen how a publicly owned network can help revitalize the city’s commercial center, they want to expand it.

The Proof Is In The Pilot

The project is a collaboration between the city of Eugene, the Lane Council of Governments (LCOG), and the Eugene Water and Electric Board (EWEB). As we reported last year, each entity contributed to the project. EWEB owns the infrastructure and uses its electrical conduit for fiber-optic cable, reducing the cost of deployment. EWEB also has the expertise to complete the installation, as well as manage and operate the infrastructure. They lease dark fiber to private Internet service providers (ISPs) to encourage competition over the shared public infrastructure. 

The pilot project brought Gigabit (1,000 Megabits per second) connectivity to four buildings in the pilot area. Vacancy rate for those four building is at zero while typical vacancy rate in Eugene is 12 percent. Matt Sayre of the Technology Association of Oregon (TAO) notes that speeds in one of the buildings, the Broadway Commerce Center, increased by 567 250 percent while costs dropped by 60 40 percent. TAO joined the other pilot project partners in 2015.

The Search For Funding

The expanded project will cost approximately $4 million to complete. In June, the City Council approved a measure to make the project eligible for Urban Renewal Funds. Urban Renewal is another label for what is also known as Tax Increment Financing (TIF), which has been used in other places for fiber infrastructure. Bozeman, Montana; Valparaiso, Indiana; and Rockport, Maine, all used Urban Renewal or TIF to help finance their builds.

Bloomington, Indiana May Bloom with an RFI

“The Gateway to Scenic Southern Indiana” could soon be the gateway to high-speed Internet access in Indiana.  The city of Bloomington, Indiana, has undertaken several projects and events in order to empower the community to find solutions to its connectivity problems.

The city of Bloomington issued a Request For Information (RFI) for a Fiber-to-the-Home (FTTH) network on March 31, 2016. City leaders have taken this next step in order to make high-speed Internet access affordable and available to all of the city’s 80,000 people.

A Bull’s Eye: The RFI

Unlike the often-mentioned Request For Proposal (RFP), an RFI does not establish a plan of action. Instead, the RFI creates a procedure for Internet service providers (ISPs), contractors, and other companies to provide information on how they would create a network to best meet the needs of the city. The city's deadline to answer any questions from interested firms is April 28th and RFI responses are due on May 12th.

Rick Dietz spoke with us the day after the city released the RFI. Dietz is the Director of ITS for the city of Bloomington. He described how the city had come to its decision to pursue a community network. The mayor and city council hired a consultant and held a symposium on high-speed networks, before releasing the RFI.

Dietz repeated the three key components that are integral to the RFI:

  • Community-wide connectivity, to enable everyone to use the network.
  • Community-control, to ensure the network meets the community’s needs.
  • Financial sustainability to the community in the future.

Without these principles, a new network will likely not be right for Bloomington. The RFI calls for any incumbent providers, local providers, or others to describe their ideas to achieve these goals, whether through a private public partnership or not. The City has taken a number of steps to enable this process to go smoothly.

OECD Study on Munis Digs Deep, Discovers Dividends

A recent large-scale cross-national study from the Organisation for Economic Co-operation and Development (OECD) offers strong evidence that municipal broadband networks provide numerous benefits for communities around the world. Among the study’s major findings include evidence that municipal networks contribute to efforts aimed at improving local economic development, stimulating business productivity and innovation, and enhancing people’s quality of life.

The study's analysis of European nations is of special interest to us as European municipal networks are the only international municipal networks in the study that closely resemble U.S. municipal networks. In particular, the findings from the study’s central econometric analysis of Swedish municipal networks have direct implications for our understanding of the impact of municipal networks in the United States.

Findings from Econometric Analysis of Sweden

As the researchers note, extensive municipal broadband development across Sweden has contributed to a remarkably high level of nationwide fiber penetration, putting the country far ahead of the US in global rankings. The researchers report a series of features and benefits of Sweden’s widespread fiber penetration and aggressive municipal broadband efforts, including:

Increased rates of employment (with even greater employment increases in highly urbanized municipalities), increased business creation, and reduced car usage (also greater in the most urban cities) as fiber networks make it easier to telecommute to work and to shop for goods and services online.

Fact Sheet On Rural Connectivity In North Carolina

The Coalition for Local Internet Choice North Carolina chapter (CLIC-NC) and the Community Broadband Networks Team here at the Institute for Local Self-Reliance (ILSR) have teamed up to create a new fact sheet: Fast, Affordable, Modern Broadband: Critical for Rural North Carolina.

This fact sheet emphasizes the deepening divide between urban and rural connectivity. The fact sheet can help explain why people who live in the country need services better than DSL or dial-up. This tool helps visualize the bleak situation in rural North Carolina and offers links to resources.

Rural North Carolina is one of the most beautiful places in the country but also one of the most poorly served by big Internet access providers. The gap between urban and rural connectivity is growing wider as large corporate providers choose to concentrate their investments on a small number of urban areas, even though 80 percent of North Carolina's counties are rural.

To add insult to injury, North Carolina is one of the remaining states with barriers on the books that effectively prohibit local communities from making decisioins about fiber infrastructure investment. CLIC-NC and ILSR encourage you to use the fact sheet to help others understand the critical need for local authority.

Minnesota Public Officials at Home and In D.C.: Funding Rural High-Speed Internet

It’s getting to be a sad, repetitive tale: crappy Internet for rural populations. Minnesota public officials hope to change that. At both state and federal levels, they’re advocating for greater funding for rural high-speed Internet. 

They’ve proposed several ideas to fund rural connectivity. At the state level, Governor Mark Dayton is pushing to use $100 million of the Minnesota government budget surplus for rural broadband projects. In D.C., Congressman Rick Nolan has introduced a bill to provide funding for regional solutions, and Senator Amy Klobuchar is working on a bill for coordinating broadband installation and highway construction. Will any of these ideas work?

Minnesota Budget Surplus

Minnesota’s state government expects a $1.9 billion budget surplus, which presents an opportunity to fund large, one-time investments. The Star Tribune notes that such one-time investments in infrastructure, “especially when infrastructure is defined broadly to include roads, transit, public buildings and broadband capacity,” could prove a welcome idea. Fiber networks have high, up-front construction costs, but they offer next-generation, high-speed connectivity. Depending on what state leaders do, those high construction costs may no longer be a barrier.

With the news of the budget surplus, Governor Dayton renewed his call for $100 million (just 5% of the budget surplus) to improve broadband in rural Minnesota. Last spring, however, state legislators only approved about a tenth of that amount - around $10 million. The year before that, they had only put in $20 million. The money funds competitive grants in which companies and local governments match state dollars to build networks. Promising a “border to border broadband” approach, Dayton continues to push for funding for rural projects, but it is up to state legislators to determine what to do.

Ideas for Regional Solutions from D.C. 

Urban Renewal In Bozeman: Fiber Required!

Bozeman, Montana, continues to move forward toward a future of fiber optics connectivity. Last we checked in, the community had formed a nonprofit, Bozeman Fiber, to own and operate the community network, had started to secure private funding, and were well on their way to their end goal.

City leaders have now approved an update to the Downtown Bozeman Urban Renewal Plan to allow Tax Increment Financing (TIF) as a way to fund the project. This is an important step to ensure that the fiber infrastructure project maintains a sustainable funding source.

Amending the Plan

Ten years ago the city adopted an ordinance creating the Urban Renewal Plan and the TIF districts. The plan uses 9 principles to guide the development and growth of the community. City leaders approved amendments to the ordinance this past December to better prioritize the current needs of businesses and residents. The amendment in question would add the importance of fiber optics to the first principle, “Strengthen Downtown’s Economic Vitality.” Brit Fontenot, Director of Economic Development, described the necessity of the changes (from local news station KTVM):

"A lot of commerce happens downtown. It's not just art galleries and restaurants. We also have things like hardware stores and high-tech companies. In order to keep up with the demand downtown, we need infrastructure that can accommodate and, in this case, it's fiber optics." 

Tax Increment Financing

By amending the ordinance, the city can more easily use TIF funding for the construction costs of the fiber network. The idea behind TIF is that a community can borrow against the future increases in the property tax revenue of the area where the particular project will be developed. We’ve reported on this funding method before: it has been considered in Sanford, Maine, and Wabash County, Indiana.
