Laurinburg, NC, Looking At Connectivity Options

Laurinburg, North Carolina, is considering opening its fiber-optic network to private providers.

It’s been over a year since the community contracted with a consultant to inventory the community’s assets and provide options for expanding its use to the private sector. Since then, community leaders have discussed looking for potential partners and have met with private providers. According to the Laurinburg Exchange, the city will likely release a Request for Proposals (RFQ) as a way to let providers know they are interested in investigating ways to make excess capacity available.

Community leaders believe providers could make use of the publicly owned fiber for fixed wireless service, lease fiber for business Internet access and telephone services, web hosting, and other services. City Manager Charles Nichols said:

“The city has the capability to offer all those services now; we know this is an asset to this community and we’re trying our best to figure out a way to utilize it.”

Laurinburg already connects ten entities with its network, including County facilities, schools, healthcare clinics and hospitals, the airport, and several local businesses. Community leaders want to spur economic development by offering high-quality connectivity in Laurinburg to more businesses.

Tapping An Existing Resource

The city deployed its fiber-optic network in the mid-1990s to improve communications between city hall and its public works facilities. It later leased excess capacity to other public entities, including several facilities that obtained Internet access and data transmission through School Link. As the city has expanded network footprint, it now consists of a 100-mile ring that surrounds the county.

Laurinburg prevailed in a lawsuit commenced by BellSouth in the early 2000s when the provider argued the city had no authority to operate the system. When the trial and appellate courts examined the prevailing statute and the technology in place, however, both found for the city. Since then, state law has changed but Laurinburg’s right to operate its system is grandfathered in; they are still, however, subject to the state prohibition on expansion

Moving Forward, Remember Past Local Government Resolutions

We have already seen Virginia and Missouri take up legislation to preempt local control and deter municipal networks. Although bearing innocuous names such as the “Virginia Broadband Deployment Act,” these bills stifle competition instead of empowering communities. 

Local governments, however, have often stepped forward to champion municipal networks and push back against state preemption bills. We’ve collected several over the years. Let these excerpts of resolutions from years past inspire you throughout the rest of 2017:

2011 - Chapel Hill, North Carolina: “WHEREAS, historically it was government that funded much of the current corporate telecommunications infrastructure in the United States and government paid for and developed the Internet on which these providers depend for their profit…” (Read more here.)

2013 - Alpharetta, Georgia: “WHEREAS, House Bill 282 would tie the hands of municipal officials in their efforts to build digital networks they need to attract economic development and create a high quality of life for their citizens...” (Read more here.

Wilson Greenlight, Public Housing Authority Solve Access Gap - Community Broadband Bits Episode 236

From our research, we believe the municipal fiber-optic network in Wilson, North Carolina, has the best low-income Internet access program in the nation. Called Greenlight, the fiber network has led to job growth and been a financial success. And now it also offers $10 per month 50 Mbps symmetrical Internet access to those living in housing units owned by the public housing authority.

Greenlight General Manager Will Aycock is back again to tell us about this program and is joined by two additional guests: CEO and President Kelly Vick from the Wilson Housing Authority and Wilson Communications and Marketing Director Rebecca Agner. 

We discuss how the program was created, how it is funded, and how it is impacting the community in addition to public reaction to it. Wilson continues to set a higher bar for what a community can expect when it builds its own network and seeks creative ways to improve opportunity for its businesses and residents.

New Resource: Map, List Of Citywide FTTH Munis

It’s no small feat to plan, deploy, and operate a municipal citywide Fiber-to-the-Home (FTTH) network, but communities are doing it. We’ve put together a Citywide Municipal FTTH Networks list and a map, with quick facts at your fingertips. If your community is considering such an investment, this list can offer a starting point on discovering similarly situated locations to study.

The list is divided by state and each state heading offers a description of any barriers that exist and a link to the statute in question. Under each community, we also included relevant links such as to the provider’s website, coverage on MuniNetworks.org, and reports or resources about the network.

We used four basic criteria to put a community on our list and map:

  • The network must cover at least 80% of a city.
  • A local government (city, town, or county) owns the infrastructure.
  • It is a Fiber-to-the-Home network.
  • It is in the United States.

Fibrant Subscriber: Our Network Something To Be Proud Of

In a opinion piece in the Salisbury Post, resident Rex Boner encourages his fellow local citizens to “make 2017 the year of Fibrant.” As a relatively new transplant to Salisbury, Rex describes how he and his wife came to the city from Atlanta to be closer to his family and was pleasantly surprised by the community’s municipal Fiber-to-the-Home (FTTH) network. 

"It Seems Like A No-Brainer"

He’s amazed that more people are not subscribers because he and his wife find the service reliable, fast, and more affordable than the Internet access they had in Atlanta. Rex writes:

Fibrant is something that we should be very proud of, and I believe that it will prove to be a helpful component of our city’s economic development efforts.

Why we would collectively choose out-of-town internet and television providers who do not invest in our community and who provide more expensive and inferior service is beyond me. Throw in the fact that low Fibrant subscription rates ultimately leads to higher city costs since we own this system no matter what, and the decision to utilize it and benefit from it seems like a “no-brainer."

Ups And Downs In Salisbury

Fibrant began offering services to homes and businesses in Salisbury in 2010 and in 2015 upgraded to offering 10 Gigabit per second (Gbps) symmetrical services. The network had already been offering 1 Gbps symmetrical service for around $100 per month. Throughout the years, the community and Fibrant have had to contend with a number of difficulties. The Great Recession and stiff competitive pricing from incumbents Time Warner Cable and Comcast took their toll on the ability to quickly attract subscribers and the community’s bond rating took a hit, but has since been elevated.

Wayne County, NC, RFI: Responses Due February 28

On January 1, Wayne County, North Carolina, issued a Request for Information (RFI) for high-speed Internet service expansion or delivery.  The due date is February 28, 2017.

Survey First

Prior to releasing the RFI, the county conducted a survey that they made available online and in paper form; they sent home copies with students in the public school system. They received 628 responses of which 13.8 percent of respondents said they don't have Internet service at all. Of those that do not have the service, 58.1 percent say there is no company that will provide it to them and 23.7 percent say they can’t afford it. Fifty-nine percent of respondents were dissatisfied with their Internet access; the reason were speed, cost, and reliability, in that order.

Looking For Ideas Next

The county’s RFI expresses their desire to work with private sector providers to bring connectivity to all areas of the county, especially the areas that are currently unserved. Their goal is to get residents and businesses connected with speeds that reach the FCC’s defined broadband speeds of 25 Megabits per second (Mbps) download and 3 Mbps upload.

In order to facilitate the efforts of the private sector, Wayne County has asked potential respondents to address how issues such as pole attachments, conduit, and dark fiber would fit into their proposals. They also want respondents to let them know how federal, state, or local regulations may hamper ideas for improving connectivity in Wayne County:

Regulatory environment: Description of any rules or regulations at the federal, state or local level that could impact the feasibility or underlying economics associated with the proposed solutions. Responses should also include an explanation of any forms of proposed regulatory relief, including streamlined permitting, which could improve the economic case for the business models or network solutions proposed or for other network solutions that respondents considered but dismissed due to existing regulations and their effect on economic viability of such proposal. 

Wilson's Greenlight Provides Affordable Internet Access To Public Housing Residents

Super-fast, reliable, and affordable Internet access is coming to residents living in public housing in Wilson, North Carolina. Greenlight, Wilson’s municipal network, recently began providing 40 Megabits per second (Mbps) for $10 per month to public housing residents -- about a quarter of the service’s original cost. All services from Greenlight are symmetrical, so upload speeds are just as fast as download speeds.

“Because of this partnership, more students will be able to be online in their homes and more adults will be able to take advantage of online job training and application tools…In addition, the partnership connects more customers to the community network, thereby increasing the return on the community’s investment,” said Greenlight general manager Will Aycock.

Partners For Progress

A new partnership between the US Department of Housing and Urban Development (HUD) and Wilson’s Public Housing Authority enables residents to receive discounted Greenlight services. HUD Secretary Julian Castro visited Wilson in October to discuss the importance of Internet access, indicating it is becoming a higher priority for the Department:

"We know these days that the Internet is not a luxury; access to it is really a necessity in this 21st-century global economy. And we want to make sure every single child in our nation has access to it… Our goal is that every single public housing resident have access to the Internet."

Residents receive a router at no cost from the Housing Authority, which oversees public housing in Wilson. Greenlight, the community's municipal fiber network offers speeds from 40-100 Megabits per second (Mbps). As a service of the City of Wilson, Greenlight emphasizes its commitment to fair pricing and providing a quality product. 

“One of Greenlight’s core principles is to enhance the quality of life for all residents, making high-speed internet available for everyone… It’s an important step in bridging the digital divide,” stated City Manager Grant Goings during the initial announcement event.

Low Income Programs Not Always This Good

Blair Levin Urges Repeal of North Carolina's Restrictive HB129

At a recent WRAL TechWire event, former Federal Communications Commission (FCC) chief of staff Blair Levin urged North Carolina communities to seek a repeal of a state law that restricts local telecommunications authority, reports WRAL TechWire.

“When the new General Assembly returns to Raleigh, tell the assembly to tear down the law that prevents faster, cheaper broadband,” Levin said in a keynote address at the WRAL TechWire Executive Exchange in Wilson, N.C. Wilson's municipal Greenlight network is among the first in the nation to offer high-quality Fiber-to-the-Home (FTTH) Internet access.  

Currently, North Carolina law HB 129 prevents Wilson from expanding its Internet access service area beyond Wilson County and discourages other communities from investing in similar infrastructure. HB 129 was the subject of a legal battle when the city of Wilson (pop. 50,000) wanted to provide Internet access to neighboring Pinetops (pop. 1,400) and other communities beyond the limitations of the state law. They challenged the law, as did Chattanooga, which faced slightly different restrictions in Tennessee.

In February of 2015, the FCC ordered that Wilson could serve communities beyond the county borders, but both states appealed, challenging the agency's authority. The federal appeals court reversed that ruling in August 2016.

Under the provisions of the North Carolina law, Wilson could lose it's exemption to offer service at all, but by temporarily providing free telephone and Internet access to Pinetops, they protect their exemption. Two state legislators have vowed to take action and try to get the state law changed during the next legislative session.

NC Rural Electric Cooperatives Teach Model Collaboration

Throughout the October Broadband Communities Magazine conference, folks kept repeating this sentiment: some partnerships are smooth and others have rough patches. At the conference, we heard from several electric cooperatives who had partnered with other cooperatives to provide next-generation connectivity to their communities.

We specifically want to highlight the work of two North Carolina electric cooperatives: Lumbee River EMC and Blue Ridge Mountain EMC. They were both included in our report North Carolina Connectivity: The Good, The Bad, and The Ugly. Each co-op took the bold step of building a Fiber-to-the-Home (FTTH) network throughout sparsely populated regions. At the conference, we were able to learn first-hand about their experiences.

Despite the Distance: Lumbee River EMC & HTC

HTC Chief Executive of Marketing Brent Groome described how the two cooperatives collaborated despite being nearly an hour away from each other. Their work together has involved a commitment to similar values and dedication to improving rural communities. (Lumbee River EMC’s representative was unable to attend the conference as much of the service territory had suffered flooding from the recent hurricane.)

Lumbee River EMC’s entry into Internet service brought fiber connectivity to southeastern North Carolina. The co-op provides electricity to more than 50,000 members. In 2010, the USDA provided Lumbee River EMC with nearly $20 million in funding to install fiber. A state law, however, imposes certain restrictions on electric co-ops and USDA funding. The electric co-op had to find another company with the drive and expertise to provide Internet service.

Pinetops Threatened by Hurricane and NC Legislature - Community Broadband Bits Podcast 226

Pinetops, a town of about 1,300 outside Wilson, North Carolina, is suffering a double calamity as Hurricane Matthew has left floods and incredible damage in its wake. Less natural but no less frustrating is the unforced error by the North Carolina Legislature in effectively prohibiting municipal broadband networks.

This week, we have a doubleheader interview with Will Aycock, the General Manager of Wilson's fiber-optic Greenlight service, and Suzanne Coker Craig, a local business owner and town council member. They talk discuss the devastation from the hurricane and the threat from the town's only broadband provider being forced to leave town by an ill-conceived state statute.

We often talk about how important modern Internet networks are, but the Pinetops reaction to this storm is a stirring reminder of how true that is. Whether it was as the hurricane approached, hit, or left town, local leadership had to continue fighting to retain Wilson's Internet service because it is that important to them.

Fortunately, Wilson has announced that it will not cut off Pinetops as expected. Instead, it will offer free service, which is not prohibited by current law. Wilson is generously giving the state six months to fix the law so Pinetops is not economically harmed by losing high quality Internet access.
