U.S. Mayors Face Uphill Battle to Preserve Local Control Of 5G Deployment

As Mayors must concern themselves with everything from public safety and health to the development of the local economy and the provision of essential municipal services, they tend to have a particular focus on the infrastructure necessary to support it all, amid a cacophony of competing interests.

Over the summer, having reached consensus on the fundamental importance of “the digital infrastructure of tomorrow,” a particular focus of the United States Conference of Mayors 88th National Annual Meeting was to issue a resolution declaring the necessity of “Preserving Local Public Rights-of-Way and Regulatory Authority to Most Effectively Deploy 5G Broadband Access and Bridge the Digital Divide during the COVID-19 Pandemic.”

The Mayors’ resolution comes in response to the Federal Communications Commission’s (FCC's) 2018 preemption of local governments’ authority to regulate 5G infrastructure in their cities. 

At the heart of the regulatory debate: local governments’ ability to determine the amount of fees to charge mobile carriers that want to place 5G equipment in Rights-of-Way. In addition to putting limits on those fees, the FCC Order also sets strict timelines by which cities and towns must respond to carrier applications. The FCC decision, issued over the objections of industry observers and policy experts, essentially eliminates local communities’ ability to negotiate in order to protect their own Rights-of-Way and the poles, traffic lights, and other potential structures within those Rights-of-Way.

Preempting Local Authority

Leaders in Lancaster, California, Authorize Resolution to Allow City to Move on Muni, Other Utilities

At a Lancaster City Council meeting on May 14th, community leaders voted unanimously to take a step toward establishing several municipal utilities, including a publicly owned fiber optic network.

Good Experiences with Their Public Utility 

Lancaster Choice Energy (LCE) is the city’s municipal electric utility, but in the future may be one of several publicly owned utilities. LCE has a Community Choice Aggregation (CCA) program, which allows individual users within the community to join together for purchasing power and gives them more control over matters such as the source of their energy. Lancaster wants to become a net-zero city and is exploring a range of approaches to reach that goal.

The community also underwent traffic signal upgrades like many other California communities and has installed additional fiber as the city has started to implement Smart City initiatives. At the city council meeting, City Manager Jason Caudle noted that using the fiber optic assets to develop a community network was a strong possibility.

In an article in the Antelope Valley Press published prior to the meeting, Caudle also noted that they plan other uses for the fiber, “As part of our smart cities effort, we’ve installed fiber-optic networks already throughout our city, and then we’re looking at putting our streetlights into Wi-Fi hotspots as well as 5G networks,” he said.

In his report to the council, Caudle wrote:

The establishment of a municipal utility is the next step in continuing to ensure that citizens and businesses are provided with utility services that meet the current and future needs of the community. As a municipal utility, Lancaster will have the opportunity to utilize advanced technology, provide utility services at rates and charges that are fair and reasonable, provide high quality customer service, and provide alternatives to existing providers of utility services similar to what the City achieved through the development of the City’s CCA.

Berrien County Makes Broadband A Priority

On April 4th, 2019, the Board of Commissioners of Berrien County, Michigan approved a resolution that formally acknowledges that achieving countywide access to high-speed Internet is crucial to the county’s mission of improving quality of life for present and future generations.

Connected Nation ranks Michigan 34th among states for broadband adoption and an estimated 368,000 rural households still do not have access to FCC defined broadband at 25 Megabits per second (Mbps) download and 3 Mbps upload. Many areas of Berrien County lack access to Internet speeds over 10 Mbps download and 1 Mbps uploads. The resolution will ensure that the county commits to pursuing opportunities and partnerships that increase broadband availability.

County commissioners Ezra Scott, of New Buffalo, and Teri Freehling, of Baroda introduced the measure and have already begun taking steps to turn it into action including creating a board subcommittee that works with municipalities and community partners to pursue broadband opportunities. They're also exploring the possibility of a grant application for the newly announced U.S. Department of Agriculture (USDA) Rural eConnectivity Pilot Program (ReConnect Program). The commissioners hope that the resolution demonstrates how serious Berrien County is about pursuing countywide broadband access. As Freehling stated, “broadband is more than an option, it’s a necessity.”

City Leaders in Bozeman, Montana, Declare Broadband Essential Infrastructure

In mid-April, city leaders in Bozeman, Montana, passed Resolution No. 5031 to officially declare broadband essential infrastructure for the city. The declaration comports with the city’s long-term goal to bring high-quality connectivity throughout the community.

Pointing Out the Positives

In addition to describing the ways access to broadband has improved opportunities for residents and businesses, the language of the resolution lays out the steps Bozeman has already taken. In addition to establishing a planning initiative, the resolution describes their decision to adopt a master plan, and the creation of nonprofit Bozeman Fiber. The resolution also chronicles the city’s investment and urban renewal plan, which includes Bozeman Fiber, and the fact that broadband has become a contributing factor to the city’s social and economic health.

As part of the resolution, the City Commissioners include their next steps in order to advance citywide connectivity in Bozeman:

NOW, THEREFORE, BE IT FURTHER RESOLVED that the City of Bozeman will; 1) create and implement a conduit utility master plan and begin the transition for operating the conduit system as its own enterprise fund; 2) include a conduit design and construction standard as part of the City’s approved engineering standards; 3) maintain updated record drawings and GIS mapping of the City-owned conduit network; 4) consider the expansion of the existing City-owned fiber optic conduit network infrastructure when appropriate and when funding is available; 5) utilize conduit lease revenue for the purchase of additional public conduit; and 6) align conduit network expansion decisions with the City Budget and Capital Improvement Plans and planning processes.

Bangor, Maine, Declares Fiber Essential Infrastructure

While smaller communities in Maine are laying plans to develop community broadband networks for high-quality Internet access, the state’s third largest city indicated a shift in how they view fiber optic connectivity. At a recent city council meeting, Bangor elected officials passed a resolution declaring, “Fiber and access to the Internet is an essential service in the City of Bangor, Maine.”

When council members passed the measure, they didn’t dedicate any funding toward community broadband or authorize a specific approach, but Councilor Tyler Collins stated, “It just sets a baseline that identifies we are prepared to do more research on this project.”

The city council has heard ideas on fiber optic deployment throughout the community for at least three years and they’re now looking closer at an open access model in which ISPs deliver Internet service to the public. Property owners connected to the infrastructure would pay a utility fee, as they do now for sewer or water, and would also pay an ISP for Internet access.

City Manager Cathy Conlow:

“They’re still able to pick their provider, but it would run over city fiber. It would ensure better coverage over the city, better speeds, consistent speeds and more stable pricing.”

At this point, Conlow describes their status as “exploring.”

Mainers Are Doing It

Tacoma Resolution To Protect Privacy With Click!

Recently, state lawmakers in Minnesota passed legislation to protect Minnesotans’ online privacy. In Tacoma, the City Council made a similar move by passing a resolution asking the Tacoma Public Utilities board to prevent ISPs on the city’s fiber network from collecting and selling personal online data. The resolution was an example of local authority stepping in to fill the gap when federal policy fails.

When The State And The Feds Don't Act

Bills were introduced in the Washington State Legislature this session, but state lawmakers didn’t turn them into law. By mid-April, it appeared that the bills weren’t going anywhere so City Council members felt the need to address the issue after the Trump Administration’s FCC allowed privacy protections to lapse.

“I’ve just heard lots of concerns from community members and from boosters of the Click network about privacy,” said Councilman Anders Ibsen… “This also ensures that any private entity that rides our fiber, that uses the Click network, is held to certain ground rules, just really basic ground rules about respecting the privacy of their customers.”

Tacoma's Click! publicly owned network serves about 23,000 people. Over the past few years, the community has debated the future of the network and is still considering several possible scenarios. Local Network = Local Control

More Virginia Communities Oppose Byron's Bad Broadband Bill

Three more Virginia communities declared opposition to the proposed state legislation that would limit municipal networks. Nelson County, Chesapeake, and Virginia Beach all have spoken out against the bill, HB 2108. We expect more communities to speak out over the next few weeks.

Last week, we reported that Franklin County and the City Council of Roanoke passed resolutions condemning Byron's bill. Roanoke is concerned that the bill will undo all the time, effort, and investment put into the Roanoke Valley Broadband Authority's open access network; Franklin County is considering ways to improve local connectivity with private partners.

Most of the resolutions and statements so far have passed with unanimous support. The Norfolk County’s Board of Supervisors are set to vote on a resolution this Tuesday, January 24th.

Statements Support Internet Access, Condemn HB 2108

The resolution from Virginia Beach specifically pointed out that the bill undermines the goals of Virginia’s Broadband Advisory Council. Del. Kathy Byron is the author of the bill and the chair of that council. 

“WHEREAS, the City Council of Virginia Beach supports the mission of the Broadband [Advisory] Council (“BAC”) as organized under Va. Code 2.2-2699.3 and its purpose of expediting deployment and reducing the cost of broadband access in the Commonwealth; however, passage of HB2108 and the Act would produce results that directly conflict with this purpose;”

Virginia Communities Reject State Preemption Bill

Last week, Virginia State Delegate Kathy Byron introduced a bill that, if passed, will cripple attempts for municipalities to improve local connectivity. HB 2108, the “Virginia Broadband Deployment Act, imposes specific requirements on municipal networks that would greatly limit whether communities could offer Internet access or work with private sector partners.

The City of Roanoke and Franklin County wasted no time in unanimously passing resolutions to oppose the Virginia bill.

Franklin County Formally Opposes HB 2108

The Franklin County Board of Supervisors swiftly drafted their resolution in order to take it to the press conference in Richmond the next day. Reprinted below is the text of the Franklin County Resolution: 

WHEREAS, broadband access and reliability are essential to citizens, businesses, and non-profits in Franklin County; and

WHEREAS, citizens, businesses, and non-profits desire faster and more reliable broadband speeds; and

WHEREAS, areas of Franklin County lack broadband access; and

WHEREAS, we seek to maximize County policy and funding options to improve broadband access and reliability; and

WHEREAS, Franklin County seeks to protect the proprietary information of local businesses;

NOW BE IT THEREFORE RESOLVED, we the Franklin County Board of Supervisors do hereby formally oppose House Bill 2108, the Virginia Broadband Deployment Act.

City of Roanoke: "We Say No Way"

The City of Roanoke Council unanimously passed a similar resolution condemning the bill. Several council members specifically discussed the impact of such legislation on the new Roanoke Valley Network and on their community’s Internet access.

Moving Forward, Remember Past Local Government Resolutions

We have already seen Virginia and Missouri take up legislation to preempt local control and deter municipal networks. Although bearing innocuous names such as the “Virginia Broadband Deployment Act,” these bills stifle competition instead of empowering communities. 

Local governments, however, have often stepped forward to champion municipal networks and push back against state preemption bills. We’ve collected several over the years. Let these excerpts of resolutions from years past inspire you throughout the rest of 2017:

2011 - Chapel Hill, North Carolina: “WHEREAS, historically it was government that funded much of the current corporate telecommunications infrastructure in the United States and government paid for and developed the Internet on which these providers depend for their profit…” (Read more here.)

Local Communities Appeal to State Leaders: Change State Anti-Muni Law

Some of us remember it - not so fondly - as a discarded relic of an early era of the Internet. But it’s not a relic for people in some parts of rural Tennessee: the awful sound of a dial-up modem.

There are approximately 28,000 people living in the county and as Marion County Mayor David Jackson tells it, he knows residents with no Internet access at all. Some of Marion County residents with nothing better than dial-up can actually look across the Tennessee River and see buildings and houses served by Chattanooga's EPB’s gigabit Fiber-to-the-Home (FTTH) network.

Given this stark contrast, it’s no wonder the push is intensifying for more access to publicly owned Internet networks in Tennessee.

Marion County Wants Local Authority

Elected officials from the Marion County Commission and the town of Kimball are the latest communities to vote on resolutions asking state leaders to change Tennessee’s state anti-muni law. The legal barrier prevents existing municipal utilities from expanding their fiber network footprints to provide telecommunications services to neighboring communities. 

In fact, city leaders in every Marion county municipality have plans to vote on their own resolutions asking the same thing: give us the local authority to decide for ourselves.

While the U.S. Court of Appeals considers whether or not to reverse the FCC decision to roll back the state barrier, communities are calling on the legislature to solve the problem by restoring local authority.

As Communities Succeed, the Municipal Fiber Movement Grows

These communities hope that changing the law will enable Chattanooga to extend its much celebrated EPB network to serve the people of Kimball and other communities in Marion County. The efforts come in the wake of similar requests out of Bradley County.
