Estes Park, CO, Moving Ahead One Year After Opt Out Vote

Estes Park, Colorado, recently moved into the design engineering phase as it considers how to bring high-quality connectivity to businesses and residents.

One Step At A Time

With a $1.37 million grant from the Energy Mineral Impact Assistance Fund, the Colorado Department of Local Affairs (DOLA) is providing the funding to proceed with the engineering phase. Larimer Emergency Telephone Authority (LETA) is providing additional grant funding to extend the project further to include a wider geographic area for 911 and public safety purposes.

This phase of the project should be complete by next summer and will result in a shovel-ready plan. At that time, the Town Board will consider the information and decide how to proceed. The goal is to develop a network to make Gigabit per second (1,000 Mbps) capacity available to the Estes Park Light and Power service area.

So Far, So Good

Last fall, 92 percent of those voting on the issue chose to opt out of SB 152, the restrictive state law that prevents Colorado local governments from offering telecommunications services or advanced services or partnering with private partners to do so. Since then, they have hired a consultant to draft a feasibility study and examine model business options.

The community’s municipal electric utility already has fiber in place, and has the personnel, knowledge, and significant assets to ease the operation and management of a Fiber-to-the-Home (FTTH) network utility. The consulting firm estimated that, if the city chooses to deliver services themselves, they should focus on Internet access rather than adding video and voice to the list of services. Estimates for the project are approximately $27 - $30 million.

Voices From Colorado's Local Authority Sweep On PRX

Colorado voters overwhelmingly reclaimed local authority in 26 counties and municipalities on Tuesday, November 8th. The total number of Colorado communities that have now reclaimed local authority is 95.

Citizens chose to opt out of state law SB 152, which prevented local governments from offering telecommunication services or advanced services to the general public. The law also bars them from partnering with the private sector and since 2008, a growing number of communities have put the question on the ballot. 

We reached out to Sallie Clarke, County Commissioner in El Paso County and Brian Waldes, Director of Finance and Information Technology in Breckenridge for comment on their communities’ ballot measures; both passed with hearty margins. We also touched base with Virgil Turner who is the Director of Innovation and Citizen Engagement in Montrose, which passed a similar initiative in 2014.

Jamming At DAPL Protest? Ask The FCC To Investigate

According to a 2014 Enforcement Advisory, cell phone and Wi-Fi jamming by state and local law enforcement is illegal by federal law. And yet, persistent allegations of jamming are coming from Water Protectors at the Standing Rock protests in North Dakota. Any jamming by law enforcement to monitor protestor cell phone communications is a serious breach of their Fourth Amendment rights as it amounts to unreasonable search and seizure. First Amendment rights of freedom of speech are also compromised when the method of transmitting reports is purposely blocked.

In order to pressure the FCC to determine whether jamming is happening in North Dakota, MoveOn.org has posted an online petition. From the petition:

Proving or disproving allegations about jamming is very difficult for anyone except the Federal Communications Commission [FCC]. Only the FCC can work with wireless providers, protesters, and local law enforcement to find out definitively what’s going on. The FCC is the only expert agency with authority to require law enforcement to disclose their use of any wireless devices and the only agency with the expertise to assess what is actually happening. If the FCC investigates and finds that there is no illegal jamming happening, then it can settle this concern. If the FCC discovers that there is illegal jamming happening, it has an obligation to expose the jamming and use its power under federal law to order local law enforcement to stop interfering with First Amendment rights of freedom of speech and freedom of the press.

As Harold Feld writes in his recent blog article, that the presence of IMSI catchers or Stingrays, leaves signs that the Water Protectors are experiencing at Standing Rock - sudden loss of a strong signal at inopportune times, cell phone batteries depleting quickly and inexplicably. Cell phones not only allow them to communicate with each other, but allow them to document law enforcement reaction:

Ammon Wins NSF Grant To Pursue Networking Technologies for Public Safety

The city of Ammon, Idaho, continues to garner more recognition and opportunities from its unfolding municipal fiber network.

In a recent news release, Ammon officials announced the city received approximately $600,000 from the National Science Foundation (NSF) to partner with the University of Utah. They will research and develop a series of next-generation networking technologies supporting public safety. 

Pursuing SafeEdge

Called SafeEdge, the nearly initiative will give Ammon residents connected to the city's network the opportunity to participate in the initiative to develop applications such as broadband public emergency alerts. 

Ammon officials said a major focus of the research will be to evaluate the “feasibility of mixing public safety applications with other applications and services,” such as consumer streaming and data sharing, remote classroom access, and dynamic access to judicial functions, including remote arraignments and access to legal representation.

The city added “It is expected that this open access/multiservice approach will improve the economic feasibility of deploying broadband services in small and rural communities by allowing a variety of services to be deployed across the same infrastructure, while at the same time ensuring that public safety applications can function in this environment.”

Three-year Project

The National Science Foundation and US Ignite, an initiative promoting U.S. leadership in developing and implementing next-generation gigabit applications that can be used for social good, are providing nearly $600,000 in funding over a three-year period for the Ammon project. About $235,000 of that funding will go to Ammon as sub awardee, the city said. The project period runs from Oct. 1, 2016 to September 30, 2019.

Innovative Ideas in Idaho

It's a great recognition for the innovative little city in Idaho. They have been incrementally building an open access Fiber-to-the-Home (FTTH) network for years. In 2015, they won an award for designing an ultra high-speed application to use the network to coordinate responses to school shootings. And earlier this year, they approved an ingenious funding method: a Local Improvement District (LID). Residents will have the choice of opting into the costs and benefits of the fiber project or opting out completely. 

A New Model

It's all about people's choice; Ammon’s open access model itself empowers community members. Instead of making frustrating phone calls with large corporations, residents can change their Internet Service Provider (ISP) simply and quickly from a sign-up portal. The infrastructure remains the same, and the providers focus on offering the best customer service. Ammon’s open access model is the virtual end of cable monopolies.

Better Connectivity, Better Public Safety

For public safety, fiber networks can offer new opportunities and improve existing services. Last year, Ammon, Idaho, created an award-widding, high-speed application to provide real-time information about school shooters to emergency responders. This year, Chattanooga is continuing to improve its video infrastructure at public housing.

The police force for the Chattanooga Housing Authority (CHA) now use fiber connectivity to identify and locate suspects - protecting victims and witnesses who fear having to testify in court.

Fiber For Reliable Cameras

The Times Free Press reported on how the CHA has already installed over 50 high-resolution digital cameras in half of its family housing sites. The old cameras were connected via a wireless network, which occasionally lost signal.  All the new cameras are hooked up to a fiber network - a huge improvement in reliability. Officers can now view images from the new cameras with smartphones, tablets, and other computers. Rather than having to return to the precinct, law enforcement can see images while they are still at the site.

Installing the 50 high-resolution digital cameras cost $200,000. In an effort to continue improving video evidence, the CHA has recently applied for a $5,000 grant from the Tennessee Municipal League. With a local match of $5,000, the CHA will upgrade the video equipment in some of the elderly high-rise buildings.

The Digital Video Recording As The Witness

Reaction to the presence of surveillance cameras at the CHS facilities varies. While some people know the footage will help prosecute those who commit crimes, they don't believe the cameras will deter criminal activity. Others feel safer with the cameras in place. 

Video footage is evidentiary and often considered more reliable than eyewitness testimony. While prosecuting those that harm people living at CHS facilities and deterring crime are important, the primary goal is to create a safer environment for residents. Without the added pressure to testify, people who experience criminal activity at CHS facilities can move on with their lives with one less thing to worry about.

Legal Eagles: Ammon FTTH Can Fly As Planned

Ammon now has judicial confirmation to move ahead on their Fiber-to-the-Home (FTTH) project.

As we reported earlier this year, Ammon's Fiber Optic Department, led by IT Director Bruce Patterson, is on the verge of commencing the next phase of its incremental network deployment. Bruce explained to Chris in Episode #173 of the Community Broadband Bits podcast, how the city will create a utility and residents who choose to participate will pay to have the network connected to their homes. The first area where FTTH will be deployed includes approximately 300 properties.

Innovative Participation Model

As Bruce put it:

"…[I]t seems logical that since fiber to your home raises your property value that we'd find some way to bond for that and put the payment for that bond as on assessment on your property tax because it does actually increase your property value so that's our goal. We do that with what they call a local improvement district."

Ammon intends to issue bonds that will then be paid with funds from assessments levied on the properties of those who wish to connect to the network. If a property owner wants to connect to the network, they will also become a "Utility Member" and will pay a monthly fee to use the service. Ammon's FTTH network will be open access; the city will not provide retail services but will maintain and operate the infrastructure. Residents will subscribe to the services offered by ISPs that operate over the network.

Ammon also intends to offer a low-cost option that will allow Utility Members to access basic functions, such as checking email, messaging, and file transfers without the need to subscribe to an ISP. Their plan will allow people in the community who cannot afford more advanced services to still have access to basic Internet tools.

In order to determine which neighborhoods want fiber, Ammon asks residents to sign up so they know where to aim the next build.

One Touch Make Ready and Wireless Innovation in Louisville - Community Broadband Bits Podcast 193

When we asked Ted Smith, Chief Innovation Officer of Louisville, Kentucky, to join us for episode 193 of the Community Broadband Bits Bits podcast, we expected to talk about the one touch make ready policy they had enacted (and AT&T has since sued to stop). We did, but we ended with a focus on how networking is already improving the city. 

We start off by focusing on the problem of adding new fiber networks to existing poles (many of which are owned by telephone company incumbents that are not particularly inclined to make life easy for new competitors). One touch make ready simplifies the process, resulting in many benefits for communities in addition to lowering the cost to build new networks. We explore that topic to start. But at the end of the discussion, Ted and I discuss what Susan Crawford has termed a responsive city approach - Louisville is using all kinds of network attached devices to improve city services in some of the lowest income neighborhoods.

Nebraska Network Begins To Grow In Lincoln Conduit

Approximately 30,000 businesses and residential properties in downtown Lincoln, Nebraska, will have access to gigabit Fiber-to-the-Home (FTTH) by the end of 2016.

ALLO Communications recently announced that is it ready to begin the first phase of its four-phase plan to bring better connectivity to the town of 269,000. ALLO will use the city owned network of conduit installed in 2012 to house its fiber and expand where necessary. 

The arrangement will bring a triple-play fiber network of video, voice, and data to the entire city by 2020. The minimum speed available will be 100 Megabits per second (Mbps) and a 1 gigabit per second option will also be available. Both tiers will provide symmetrical speeds so upload will be just as fast as download.

In addition to improving connectivity for residents, businesses, and anchor institutions, the network will improve public safety. When he announced the start of construction, Mayor Chris Buetler said:

“The city will also be able to utilize the fiber system to work with traffic lights and traffic flow. This will allow new smarter traffic flow, less idling cars and help eliminate pollution. This project is another example of public private partnerships and is evidence of how this process benefits the city and its people."

Lincoln is only one of several communities that understand the value of conduit for potential partnerships or for future municipal investment. Boston Globe: Build A Muni

The Editorial Board from the Boston Globe recently kicked off a series titled "The Cutting Edge of the Common Good." The editors intend to offer suggestions for how to create a prosperous city through ideas to benefit Boston's 4.7 million residents. 

Their first proposal? Build a municipal fiber network.

In the editorial, the Board point out how the city has always been a cutting edge leader, from Revoluntionary War to same-sex marriage. But when it comes to developing the tech sector, the "City on a Hill" is being edged out by Chattanooga, Lafayette, Louisiana, and Cedar Falls, Iowa. High-tech innovators are flocking to communities with municipal fiber networks.

As the Globe notes, connectivity could be better in Boston:

The truth is that our tech infrastructure is in the same dismal shape as our roads and bridges. Boston, like a majority of American cities, pays more for slower Internet service than our international peers. If Boston is to remain a global hub of innovation — and on the “cutting edge of the common good,” as Mayor Martin J. Walsh promised in his State of the City address last month — it should build a citywide fiber-optic network that allows each residence and business an onramp to the information superhighway of the future.

Even though the city has its own conduit network and significant fiber assets, residents and businesses must seek service from large private providers. The Globe Editors believe the city should rethink the current approach:

But the City of Boston should not gamble its future competitiveness in a Mountain View lottery, nor should it entrust such vital infrastructure entirely to private hands.

The private market would be the ideal solution in an ideal world, but in Boston the market has failed.
